TCPA Compliance Disclosure

HMD Consulting Group, LLC DBA Clear Choice Marketing Group ("Company") is committed to compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and all related federal and state regulations governing consumer contact.

Lead Sources & Consumer Consent

Consumer leads are sourced from two categories.

Company-Owned Properties: Leads generated through Company-owned and operated websites, landing pages, and marketing campaigns where the Company directly controls consent language and data collection practices.

Third-Party Publishers & Affiliates: Leads sourced from independent publishers and affiliate partners operating under written agreements with the Company. These publishers are contractually required to obtain prior express written consent from consumers before their information is submitted. All consent language informs consumers that they may be contacted by phone, email, or text by companies in the relevant vertical regarding the service they inquired about.

Buyer Responsibility

Buyers are solely responsible for: Ensuring contact methods comply with the TCPA, TSR, and all applicable federal and state telemarketing laws. Maintaining their own DNC suppression lists and honoring all opt-out requests promptly. Ensuring any automated dialing systems, pre-recorded messages, or text campaigns comply with applicable law. Obtaining any additional consent required for their specific contact methodology.

Do Not Call Compliance

Buyers must honor the National Do Not Call Registry and all applicable state DNC lists. The Company provides leads in good faith based on consent collected at the time of opt-in but does not guarantee leads are free from DNC registrations at the time of contact.

Opt-Out & Stop Requests

Buyers must honor all consumer opt-out and stop requests immediately. Consumers requesting removal must be added to the Buyer's internal DNC list within the timeframe required by applicable law.

Publisher Compliance Standards

All third-party publishers and affiliates are required to: Obtain prior express written consent from each consumer. Maintain consent records and make them available upon request. Comply with all TCPA, TSR, CAN-SPAM, and applicable state regulations. Immediately notify the Company of any known consent deficiencies.

Indemnification

Buyers agree to indemnify, defend, and hold harmless HMD Consulting Group, LLC DBA Clear Choice Marketing Group, its officers, employees, owned properties, publishers, affiliates, and agents from any TCPA claims, regulatory actions, damages, or penalties arising from the Buyer's contact practices.
